The Legal Framework For The Administration's Authority To Stop Environmentally Polluting Activities
Abstract
This research examines the legal framework for the administration's authority to stop environmentally polluting activities in accordance with Environmental Protection and Improvement Law No. 27 of 2009. It attempts to highlight shortcomings in the legal standards governing this authority. The research also demonstrates the absence of clear criteria for stopping activities and the lack of a time limit for extension. It also discusses the weakness of oversight mechanisms for the implementation of stoppage decisions. The research proposes legal amendments to enhance the effectiveness of this authority and ensure a balance between environmental protection and the continuation of economic activity in a sustainable manner.
